Nick Berberian and Tina Winer, attorneys in NGE's Securities Litigation & Regulatory practice group, successfully defended Morgan Stanley in a twelve-day arbitration before the Financial Industry Regulatory Authority brought by a former employee. The former employee asserted various claims including defamation and sought over $20 million in damages as well as expungement of the reasons Morgan Stanley reported for his termination of employment. The three-person arbitration panel issued a unanimous decision on May 12, 2022, denying in their entirety all of the claims asserted by the former employee, including his claim for expungement, and awarded Morgan Stanley the full amount of its counterclaim resulting from mistaken overpayments to him.
