Andrew Douglass, partner in the firm’s Employee Benefits & Executive Compensation group, was recently quoted in the Law360 article, “What To Know About 'Novel' Johnson & Johnson ERISA Suit.” The article looks at the lawsuit filed by a Johnson & Johnson worker alleging that the company breached its fiduciary duty under ERISA by failing to demand lower prices from its pharmacy benefit manager, Express Scripts, resulting in overcharging for drugs.
In the article, Andrew mentioned this suit “was ‘very much an extension of what we saw in the 401(k) world’ when it comes to ERISA class actions from workers and retirees who claim they were saddled with excessive fees.”
