NGE Intellectual Property attorneys Emer Simic, Jeff Ward and Charlie Shih attended the American Conference Institute’s (ACI) 10th Annual Paragraph IV Disputes Conference, which took place from October 15-16, 2024, in Chicago, IL. The conference provided attendees with updates on Hatch-Waxman litigation and valuable networking opportunities.
On October 15, Emer Simic joined the panel discussion “Assessing Patent Portfolios Post In Re Cellect: Insights on Obviousness Type Double Patenting, PTA and Terminal Disclaimers.” The session examined the Cellect case and the implications for patent portfolios moving forward, analyzing the Federal Circuit’s holding impact in recent Hatch-Waxman cases, using the In re Cellect decision to audit patent portfolios for ODP concerns, navigating loss of exclusivity for a product, devising strategies in drafting claims for first filed and continuation applications to avoid OTDP concerns and adapting approaches to patent prosecution and litigation.
